Welcome to Love At First Sound LLC ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our mobile elective ultrasound services ("Services") provided in your home in Arizona through our website LoveAtFirstSoundAz.com (the "Website"), built and hosted on the Wix platform. By booking, scheduling, or receiving our Services, you ("you," "Client," or "your") agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Services.
Our Services are non-diagnostic, elective ultrasound sessions intended for entertainment and bonding purposes, such as viewing your unborn baby in 2D, 3D, or 4D imaging. These Services are not a substitute for medical care or diagnostic ultrasounds provided by a licensed healthcare provider.
About Our Services
1.1 **Nature of Services**: We provide mobile elective ultrasound services in clients’ homes in Arizona, using portable ultrasound equipment to produce 2D, 3D, or 4D images and videos of your unborn baby. These Services are for keepsake and bonding purposes only and are not intended to diagnose medical conditions, assess fetal health, or replace prenatal care.
1.2 **Non-Medical Purpose**: Our sonographers are trained to perform elective ultrasounds but are not OB licensed medical professionals authorized to provide medical advice or diagnoses for OB exams. Any observations during the session (e.g., heartbeat, gender) are for entertainment purposes and must be confirmed by your healthcare provider.
1.3 **Prenatal Care Requirement**: You must be under the care of a licensed healthcare provider and have had at least one diagnostic ultrasound to confirm your due date and screen for fetal anomalies before receiving our Services. We do not require a doctor’s note but reserve the right to verify prenatal care status.
1.4 **Service Area**: We provide Services in Maricopa County. Travel fees may apply for locations outside our standard service area, as specified during booking.
1.5 **Mobile Service**: Services are performed in your home using portable ultrasound equipment. You must provide a suitable space (a clean area with access to a power outlet) for the session. We reserve the right to cancel or reschedule if the environment is unsuitable.
Eligibility and Consent
2.1 **Age Requirement**: You must be at least 18 years old or have parental/guardian consent to book or receive our Services.
2.2 **Pregnancy Stage**: Our Services are recommended for clients between 5 and 40 weeks for optimal imaging. We may refuse service if you are outside this range or if imaging is unlikely to produce satisfactory results due to gestational age, fetal position, or other factors.
2.3 **Health and Safety**: You confirm that you have no medical conditions or complications that contraindicate elective ultrasound. You must disclose any high-risk pregnancy conditions to us before the session.
2.4 **Informed Consent**: By booking our Services, you consent to the ultrasound procedure, use of ultrasound gel, and recording of images/videos. You acknowledge that ultrasound uses sound waves, which studies have found safe over 30 years, but no medical procedure is without risk.
2.5 **Guest Policy**: You may invite as many guests to the session as you'd like, including children.
Booking and Payment
3.1 **Booking Process**: Bookings are made via our Website, phone (602)882-4268, or email LoveAtFirstSoundAz@yahoo.com. A minimum deposit of $50 is required to secure your appointment, with the remaining balance due at the time of booking or at the time of service.
3.2 **Pricing**: Prices for Services, including session packages and keepsake items (e.g., photos, flash drives, heartbeat toys), are listed on our Website or provided during the session. All prices are subject to Arizona sales tax.
3.3 **Payment Methods**: We accept credit/debit cards, cash, Zelle, Venmo, Cash App. Payment for tangible items (e.g., gender reveal confetti cannon, heartbeat bear) is subject to Arizona sales tax, even if separately itemized. We do not accept insurance, as our Services are elective and non-medical.
3.4 **Cancellation and Rescheduling**:
**By You**: Cancellations or rescheduling requests must be made at least 24 hours before the appointment. Deposits are non-refundable. No refunds for no-shows or cancellations within 24 hours.
**By Us**: We may cancel or reschedule due to equipment issues, sonographer unavailability, unsafe conditions, or other unforeseen circumstances. You will receive a full refund or the option to reschedule.
3.5 **Refunds**: Refunds are not issued for unsatisfactory image quality due to factors beyond our control (e.g., fetal position, amniotic fluid levels, maternal body type). We may offer a complimentary re-scan at our discretion if images are suboptimal. No refunds for keepsake items once delivered.
Session Details
4.1 **Duration**: Sessions typically last 15–30 minutes, depending on the package selected. Additional time may be offered at our discretion but is not guaranteed.

4.2 **Preparation**: You must follow preparation instructions provided during booking (e.g., hydration for optimal imaging). Failure to prepare may affect image quality, and no refunds will be issued.
4.3 **Image Quality**: We strive to capture high-quality images but cannot guarantee results due to factors like fetal position, gestational age, or maternal conditions. We make no promises that images will match those seen elsewhere.
4.4 **Keepsake Items**: Photos, videos, or other keepsakes (e.g., heartbeat toys) are provided as part of certain packages. Digital images/videos are delivered via secure link or USB drive. Physical items are subject to Arizona sales tax.
4.5 **Gender Determination**: If requested, we may attempt to determine fetal gender, but accuracy is not guaranteed.
4.6 **Safety Protocols**: Our equipment complies with FDA guidelines for elective ultrasound, and sessions are conducted within safe exposure limits. We use FDA-approved gel, which is safe and biologically inert.
Privacy and Data Protection
5.1 **HIPAA Compliance**: As an elective, non-medical service, we are not subject to HIPAA regulations. However, we implement strict data security measures to protect your personal information, including encrypted storage and secure networks.
5.2 **Personal Information**: We collect personal information (e.g., name, contact details, pregnancy details) to provide Services and comply with Arizona law. See our [Privacy Policy] for details on data collection, use, and sharing.
5.3 **Image and Video Storage**: Images and videos are stored securely for 30 days after the session and then deleted unless you request longer retention. You may request access to your images via a secure link.
5.4 **Confidentiality**: Our sonographers and staff are trained to maintain confidentiality. We do not share your images or personal information with third parties, except as required by law (e.g., Arizona Data Breach Notification Law, A.R.S. § 18-552).

5.5 **Data Breach Notification**: If a security incident compromises your personal information, we will notify you within 45 days if substantial economic loss is likely, per Arizona law (A.R.S. § 18-552).
Liability and Disclaimers
6.1 **No Medical Advice**: Our Services are not medical procedures, and we do not provide medical advice, diagnoses, or treatment. Always consult your healthcare provider for medical concerns.

6.2 **Limitation of Liability**: To the fullest extent permitted by Arizona law, we are not liable for any direct, indirect, incidental, or consequential damages arising from your use of our Services, including unsatisfactory images, reliance on session observations, or equipment malfunctions. Our liability is limited to the amount paid for the session.
6.3 **Indemnification**: You agree to indemnify and hold us harmless from any claims, damages, or losses arising from your misuse of our Services, violation of these Terms, or reliance on non-medical information provided during the session.
6.4 **Equipment Safety**: We maintain our ultrasound equipment in accordance with manufacturer and FDA guidelines. You assume the risks associated with elective ultrasound, which are minimal based on over 30 years of safety studies.

6.5 **Force Majeure**: We are not liable for delays or cancellations due to events beyond our control, such as natural disasters, power outages, or government restrictions.
Arizona Legal Compliance
7.1 **Business Licensing**: We are registered with the Arizona Corporation Commission and hold all necessary permits to operate as a mobile elective ultrasound business.
7.2 **Advertising Restrictions**: We comply with Arizona restrictions on advertising.

7.3 **Data Disposal**: We securely dispose of personal information when no longer needed, per Arizona’s data disposal law (A.R.S. § 44-1373).
7.4 **Tax Obligations**: Charges for tangible items (e.g., jump drives, confetti cannons) are subject to Arizona sales tax, as required by the CDTFA guidelines adopted in Arizona. We are registered with the Arizona Department of Revenue to report and pay applicable taxes.
7.5 **No State Licensure for Sonographers**: Arizona does not require state licensure for ultrasound technicians, but our sonographers are trained in 3D/4D ultrasound techniques and hold credentials from ARDMS.
Intellectual Property

8.1 **Ownership**: All content on our Website, including images, logos, and text, is owned by us or our licensors and protected by copyright and trademark laws.
8.2 **Use of Images**: You may use images and videos from your session for personal, non-commercial purposes. You grant us a non-exclusive, royalty-free license to use anonymized images for marketing purposes unless you opt out in writing.
8.3 **Prohibited Use**: You may not reproduce, distribute, or modify our Website content or session images for commercial purposes without our written consent.
Dispute Resolution
9.1 **Governing Law**: These Terms are governed by Arizona law, without regard to conflict of law principles.
9.2 **Informal Resolution**: If a dispute arises, you agree to contact us at LoveAtFirstSoundAz@yahoo.com to attempt resolution before pursuing legal action.
9.3 **Arbitration**: Any unresolved disputes will be settled by binding arbitration in Mesa Arizona, conducted by a single arbitrator under the American Arbitration Association rules. You waive the right to a jury trial or class action.
9.4 **Venue**: If arbitration is not applicable, disputes will be resolved in state or federal courts in Maricopa County, Arizona.

We may update these Terms to reflect changes in our practices or Arizona law. We will notify you of material changes by posting the updated Terms on our Website or sending an email (if applicable). Continued use of our Services after changes take effect constitutes acceptance of the updated Terms.
