Thank you for choosing Love At First Sound LLC ("we," "us," or "our") for your mobile elective ultrasound services ("Services") in Arizona. This Refund Policy outlines the conditions under which we offer refunds, rescheduling, or credits for our non-diagnostic, elective ultrasound sessions provided in your home, including 2D, 3D, or 4D imaging, gender determination (if offered), and keepsake items (e.g., photos, videos, heartbeat toys). By booking or receiving our Services, you agree to this Refund Policy, which is incorporated into our [Terms and Conditions].

 

We strive to provide a memorable bonding experience, but due to the nature of elective ultrasounds, certain factors (e.g., fetal position, client preparation) may affect outcomes. This policy ensures fairness and transparency in compliance with Arizona consumer protection laws.

 

General Refund Principles

 

1.1 **Non-Medical Service**: Our Services are for entertainment and bonding purposes only, not for medical diagnosis or treatment. Refunds are not issued based on the absence of medical outcomes or diagnostic accuracy.

 

1.2 **Arizona Consumer Protection**: We comply with Arizona’s consumer protection laws, including the Arizona Consumer Fraud Act (A.R.S. § 44-1521 et seq.) and retail transaction requirements (A.R.S. § 44-1797). Refunds are processed promptly where applicable, with clear communication of non-refundable conditions.

 

1.3 **Discretionary Refunds**: Refunds or credits beyond this policy may be offered at our sole discretion but are not guaranteed.

 

Cancellations and Rescheduling

 

2.1 **Cancellations by You**:

   - If you cancel your appointment at least 48 hours before the scheduled session, you are eligible for a full refund of any deposit or payment, less a $20 processing fee to cover administrative costs.

   - Cancellations made within 48 hours of the scheduled session are not eligible for a refund, but you may reschedule once within 30 days at no additional cost, subject to availability.

   - No refunds or rescheduling options are available for no-shows (failure to be present at the scheduled time and location).

 

2.2 **Cancellations by Us**:

   - If we cancel your appointment due to unforeseen circumstances (e.g., equipment failure, sonographer unavailability, unsafe travel conditions), you may choose:

     - A full refund of all payments, including deposits, processed within 5 business days.

     - A rescheduled session at no additional cost, subject to availability.

   - We are not liable for additional costs (e.g., travel expenses, time off work) incurred due to our cancellation.

 

2.3 **Rescheduling by You**:

   - You may reschedule your appointment once at least 48 hours before the scheduled session at no additional cost, subject to availability.

   - Additional rescheduling requests may incur a $25 fee or require a new deposit.

   - Rescheduling within 48 hours is treated as a cancellation and subject to the cancellation policy above.

 

Refunds for Session Outcomes

 

3.1 **Image Quality**:

   - We strive to provide high-quality 2D, 3D, or 4D images, but outcomes depend on factors beyond our control, such as fetal position, amniotic fluid levels, gestational age, or maternal body type. No refunds are issued for unsatisfactory image quality.

   - If images are suboptimal (e.g., fetus facing away), we may offer a complimentary re-scan within 14 days at our discretion, subject to availability and client preparation (e.g., hydration). Re-scans are not guaranteed to improve outcomes.

 

3.2 **Gender Determination (If Offered)**:

   - If you request gender determination, we attempt to provide it as part of the session, but accuracy is not guaranteed due to factors like fetal position or gestational age. No refunds are issued for inability to determine gender or incorrect gender predictions.

   - Gender determination is for entertainment purposes only and must be confirmed by your healthcare provider.

 

3.3 **Session Duration**:

   - Sessions typically last 15–30 minutes, depending on the package. If a session is shortened due to client-related issues (e.g., late arrival, unprepared environment), no refunds are issued.

   - If we end a session early due to equipment issues or our error, you may receive a partial refund proportional to the unused time or a complimentary re-scan, at our discretion.

 

Refunds for Keepsake Items

 

4.1 **Physical Items**:

   - Keepsake items (e.g., flash drives, gender reveal items, heartbeat toys) are subject to Arizona sales tax and are non-refundable once delivered, per A.R.S. § 44-1797 for retail sales, unless defective or not as described.

   - If an item is defective (e.g., unreadable flash drive), notify us within 7 days at LoveAtFirstSoundAz@yahoo.com. We will replace the item at no cost or issue a refund for the item’s value, at our discretion.

 

4.2 **Digital Items**:

   - Digital images or videos delivered via secure link or USB drive are non-refundable once accessed or downloaded, as we cannot verify non-use.

   - If digital items are not delivered due to our error, you are eligible for a refund of the item’s value or redelivery at no cost.

 

Refunds for Deposits and Payments

5.2 **Full Payments**:

   - Full payment is due at the time of booking. Refunds for full payments, less the $20 processing fee, follow the cancellation and session outcome policies above.

   - Payments for tangible items (e.g., flash drives, gender reveal items) are subject to Arizona sales tax and non-refundable unless defective.

 

5.3 **Payment Methods**:

   - Refunds are issued to the original payment method (e.g., credit card, PayPal) within 5–10 business days of approval. Cash payments may be refunded via check or electronic transfer.

 

Non-Refundable Circumstances

 

No refunds or credits are issued for:

- Failure to follow preparation instructions (e.g., hydration, full bladder) resulting in poor image quality.

- Client ineligibility discovered at the session (e.g., outside recommended gestational age).

- Emotional dissatisfaction with the experience, as outcomes are subjective and not guaranteed.

- Changes in client circumstances (e.g., pregnancy complications) after booking, unless we cancel the session.

- Force majeure events (e.g., natural disasters, government restrictions) preventing service delivery, though we may offer rescheduling at our discretion.
